Desde el pasado viernes 5 de abril del 2024, comenzó el juicio en la Audiencia Provincial de Ciudad Real, España, contra José Manuel Lomas Estrada, acusado de homicidio, por el que la piden hasta 25 años de cárcel.
Comenzó el juicio contra José Manuel Lomas Espada un jubilado de Ciudad Real, España que a partir de la madrugada del 1 de agosto de 2021 cuando empezó a ser llamado “Pepe Lomas, el justiciero“, que fue enviado a prisión provisional por matar de dos tiros a un ladrón reincidente que entró a robar a su casa.
Desde el pasado viernes 5 de abril del 2024, con 80 años de edad, está siendo juzgado en la Audiencia Provincial de Ciudad Real acusado de homicidio por el que la piden hasta 25 años de cárcel.
Pepe tenía sus armas de caza en regla, el presunto ladrón entró de madrugada a robar y él era un anciano.
A pesar de todo eso, Pepe pasó diez meses en prisión provisional y ahora, con 80 años, se enfrenta a una petición de 25 años de cárcel por asesinato por petición de la familia del presunto ladrón.
El presunto ladrón, Nelson David Ramírez, un exmilitar hondureño de 35 años con antecedentes por robo y otros delitos.
La Fiscalía pide 15 años por homicidio para Pepe.
Hasta esa madrugada del 1 de agosto del 2021 , Pepe vivía su jubilación de forma tranquila en la casa que heredó de sus padres en el barrio de La Atalaya.
Muy conocido en Ciudad Real, Pepe Lomas era el propietario de la histórica librería Aspas (ya desaparecida) de la Plaza Mayor de Ciudad Real, ya desaparecida.
Lomas vivía solo con su perro en la finca Valdelobos de La Atalaya desde su jubilación, un pastor alemán con el que compartía la casa.
Una habitación sellada con ladrillos
Su refugio era una habitación con las ventanas sellada con ladrillos “para que nadie pudiera entrar ahí”.
Pepe, que tenía 77 años cuando ocurrieron los hechos, sobrevellaba como podía la soledad y cierto miedo por su seguridad en su casa de campo.
Lomas poseía cuatro escopetas, dos de ellas de cañones paralelos, un rifle, y munición, todas con licencia y en perfectas condiciones de uso
La noche del 1 de agosto del 2021, sobre las 2 AM (hora local) , escuchó un ruido en el interior de su parcela que lo sobresaltó, pensó que le estaban robando, y echó mano de una de las armas que tenía cerca, una escopeta calibre 12 cargada con dos cartuchos.
Al salir de la casa Lomas vio al intruso con una motosierra de su propiedad, en la mano.
El presunto ladrón estaba robando esa herramienta y Pepe se acercó a él apuntándole al parecer sin advertir su presencia, cuanto estuvo a cinco metros le disparó un tiro mortal que le dio en el tórax y un segundo un poco más cerca, por los que Nelson, el presunto ladrón, murió en el acto.
Después de disparar al intruso Pepe Lomas avisó a la Policía Nacional para que socorriesen al herido. Unos días después, el 3 de agosto del 2021, ingresó en prisión provisional como autor del homicidio “del intruso”.
Un tribunal popular
Pepe pasó diez meses en prisión provisional. El pasado viernes 5 de abril del 2024 ha comenzado el juicio por el homicidio del exmilitar hondureño y presunto ladrón Nelson David Ramírez.
Lomas se sienta frente a un jurado popular en la Audiencia Provincial de Ciudad Real.
La Fiscalía de Ciudad Real le pide al librero jubilado un total 12 años y 6 meses de cárcel. Le considera culpable de homicidio.
La clave del asunto para la fiscalía es el segundo disparo que efectuó Pepe Lomas.
Tras el primer disparo “cuando se encontraba a escasos 4 metros de la víctima, el acusado efectuó un segundo disparo por la espalda que impactó en la cara posterior del tórax ocasionándole también heridas mortales”.
Después, continúa la Fiscalía, Pepe Lomas regresó al interior de su habitación y cargando de nuevo la escopeta con otros dos cartuchos más, se dirigió al lugar donde yacía el cuerpo sin vida, efectuando un tercer disparo en la misma dirección sin que le diera a Ramírez .
Según su defensa, ese disparo fue intimidatorio, ya que Pepe no podía saber si el ladrón estaba acompañado o seguía siendo un peligro. La Fiscalía mantiene que el hombre que entró a robar en la casa del librero falleció como consecuencia de los dos disparos que recibió en zonas vitales.
Hoy, el futuro de Pepe Lomas es incierto. Sabe que cuenta con cierto apoyo popular y en su casa guarda decenas de cartas de ánimo que muchos le enviaron durante su estancia temporal en prisión.
Entre ellos, el líder del partido ultraderechista español, VOX, Santiago Abascal, que así se pronunció hace tres años cuando Lomas entró en prisión provisional: “Nos acordamos de ese vecino de Ciudad Real de 77 años encarcelado por defender su casa de un inmigrante ilegal, que entró portando una motosierra. No ha sido amparado porque el Código Penal no protege convenientemente el derecho a la legítima defensa”.
